These Terms of Service ("Terms") govern your access to and use of Unwritten (the "Service"), operated by Poetiq ("we", "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or 16 if you are in the European Economic Area) to use the Service. If you are under 18, you represent that you have your parent or guardian's permission. By using the Service, you represent that you meet these requirements.
2. Accounts
To use most features you must create an account through our identity provider. You are responsible for keeping your account secure and for all activity under your account. Notify us immediately if you suspect unauthorized use.
3. Credits and Payments
The Service uses a credit system. You may purchase credits through Stripe. Credit prices, packaging, and consumption rates may change at any time. Credits have no cash value, cannot be transferred between accounts, and are non-refundable except where required by applicable law.
All purchases are final unless required by applicable law. If you believe you were charged in error, contact mike@poetiq.ai within 30 days of the charge.
4. Acceptable Use
You agree not to:
- Use the Service to generate, distribute, or store content that is illegal, infringing, defamatory, or that depicts the sexual abuse of minors
- Generate content that depicts identifiable real persons in a sexual, violent, or defamatory manner without their consent
- Use the Service to harass, threaten, or incite violence against any person or group
- Attempt to extract, harvest, or scrape content, model outputs, or training data from the Service
- Reverse-engineer, decompile, or attempt to discover the source code or AI model weights of the Service
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure
- Use the Service to send spam, malware, or other harmful code
- Impersonate any person or misrepresent your affiliation with any person or organization
- Resell, sublicense, or commercially exploit the Service without our prior written permission
- Use automated means (other than documented APIs) to access the Service
We may suspend or terminate accounts that violate these rules, with or without notice.
5. User Content
You retain ownership of the prompts, characters, premises, and other content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and display the User Content for the purpose of operating, securing, and improving the Service. This license ends when you delete the User Content, except for backup copies retained for a reasonable period and except where retention is required by law.
You are solely responsible for your User Content and represent that you have all rights necessary to submit it.
6. AI Outputs
The Service produces text, images, and video using third-party AI models. To the extent permitted by applicable law and the upstream provider's terms, you own the outputs generated for your account. You are responsible for evaluating outputs before relying on or distributing them. Outputs may be inaccurate, offensive, or unsuitable for your purpose, and similar or identical outputs may be generated for other users.
You may not represent AI-generated outputs as human-authored where such a representation would mislead a reasonable person.
7. Third-Party Services
The Service relies on third-party providers for authentication (Clerk), payments (Stripe), AI model hosting (Anthropic, OpenAI, Google, fal.ai), and infrastructure (Google Cloud Platform). Your use of those services is also subject to their terms. We are not responsible for third-party services.
8. Termination and Account Deletion
You may stop using the Service at any time and delete your account from your profile. When you request account deletion:
- 30-day grace window. Your account enters a soft-deleted state for 30 days, during which signing in restores full access. After 30 days the deletion becomes permanent and cannot be undone.
- Multi-player session ownership transfer. If you own a session that other players are still in, ownership of that session will transfer to a remaining player at the end of the grace window so that those players retain access to their game. The transferred session is governed by the new owner's use of the Service. Sessions that have no other participants are deleted along with your account.
- Personal data retention. After the grace window we permanently delete or anonymize your personal data. We retain (a) records required by tax and accounting law (including credit purchases and model-spend ledger entries) for the legally required period, (b) anonymized audit records for fraud and security purposes, and (c) the minimum information needed to keep other players' sessions intact, as described in the Privacy Policy.
We may suspend or terminate your access at any time, with or without notice, including if we believe you have violated these Terms. Sections that by their nature should survive termination — including ownership, indemnification, disclaimers, and limitation of liability — will survive.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL POETIQ, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $50.
11. Indemnification
You agree to indemnify and hold harmless Poetiq and its affiliates from any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms will be resolved in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.
13. Changes
We may update these Terms from time to time. Material changes will be announced through the Service or by email. Continued use after changes take effect constitutes acceptance.
